Empowerment of FFRC for children’s educational rights

The accessibility to education is the fundamental right of the people and constitution enjoins upon the government to protect the rights of children to school education. Since the rapid expansion and extension of private schools has commercialised education in nook and corner of Jammu & Kashmir, the Government is duty bound to ensure accountability of private schoolds for the purposes of protecting the rights of children in pursing education in both private and government schools. While fulfilling it’s constitutional duty the Government has very rightly given Fee Fixation & Regulation Committee (FFRC) for Private schools the powers to fix, determine and regulate the fee structure of private schools with the spirit of  protecting the educational rights of children  in private schools . Constitution of Fee Fixation & Regulation Committee (FFRC) under an act of erstwhile J&K Assembly and the incumbent J&K Government giving it the powers for the purposes of accountability of  private schools with the intent of protecting the educational rights of children if called an attempt to crush private schools by Private Schools Association of Jammu and Kashmir (PSAJK) shows the disrespect of private schools to the institution of accountability and  the constitutional supremacy of a statutory body of the Government. Protecting the investments of private schools for quality education is not the constitutional duty of the government but protecting the educational rights and liberties of children in private schools is by all standards of understandabilities an uncompromising constitutional duty of the government which it is fulfilling to the best of the satisfaction of the people of Jammu & Kashmir. Never ever can government compromise it’s constitutional duty of protecting educational rights of children in private schools and for quality education government has would by all standards of human wisdom prefer to raise the standards of education with all latest facilities of schooling in government schools but not to boost investments by private schools.

Unfortunately people connected with the business of real estates and commercial constructions who don’t know even the basics about education are running private schools and if the Fee Fixation & Regulation Committee (FFRC) is empowered to conduct inspection of private schools for the purposes of recognition and affiliation most of the private schools will get sealed as facilities of laboratories, libraries and recreational facilities are not available in most of the private schools. What matters the most is that by questioning the constitution of the committee and notification of rules by the government Private Schools Association Jammu & Kashmir (PSAJK) is by all standards of understandabilities overtly and covertly questioning the constitutional and institutional wisdom of the Government. 

Unfortunately the claims of quality education by private schools are in total contrast to realities on ground as most of the private schools are started from rented buildings in one district and shifted to another district after years of cash fleecing practices to the utter physical inconvenience and academic interests of the enrolled students. Never forget that drivers engaged by private schools draw more salary than the teachers which by all standards of understandabilities is an insult to the institution of teacher.
