India seeks suspension of Jadhav’s death penalty at ICJ

New Delhi/Hague, May 15: Terming death sentence given to its national Kulbhushan Jadhav by Islamabad as ‘farcical’, India today urgently sought some ‘provisional measures’ from International Court of Justice (ICJ) to ensure that the sentence pronounced by a military court of Pakistan was not executed.
Presenting India’s case at the Hague court eminent jurist and former Solicitor General of India Harish Salve cited three international instances – Prague versus US, Germany versus US and Mexico versus US to press that the court had put such provision measures in place to save the rights of aggrieved parties.
Jadhav had been arrested by Pakistani agencies on March 24, 2016 and awarded death sentence on charges of espionage and subversion.
On May 9 this year, the ICJ had had communicated to the Pakistan Government that the military court’s order would not be implemented until a final decision on an application filed by India was taken.
India in its argument said that the Pakistan had denied the consular access to Jadhav 16 times.
