After a decade-long hiatus, the Jammu and Kashmir Assembly is set to hold its first session from November 4, marking a significant moment for the Union Territory (UT). This five-day session will be the first legislative sitting since the abrogation of Article 370 and the bifurcation of Jammu and Kashmir into two Union Territories in August 2019. The reconstituted Assembly, which now functions under a different political framework as part of a Union Territory, is expected to focus on a mix of ceremonial duties and legislative business. The session will serve as a critical platform for the newly elected government to present its vision and policies for the future of Jammu and Kashmir.  This session holds particular significance, not only because it is the first in ten years, but also because it will lay the groundwork for legislative discussions in a post-Article 370 landscape.

Election Of Speaker To Set Leadership In Motion: The first day of the session will be marked by the election of the Speaker of the Assembly, a pivotal moment in the functioning of the legislative body. The Speaker’s role is vital in ensuring the smooth conduct of the Assembly’s proceedings, and the election will signal the formal establishment of leadership within the Assembly.  Sources told Kashmir Horizon that Abdul Rahim Rather, a senior leader from the National Conference (NC), is the frontrunner for the Speaker’s post.  A seven-time MLA with significant experience, Rather has previously held the finance portfolio in the erstwhile state of Jammu and Kashmir, making him a strong candidate for this crucial role. Rather’s candidacy is being considered seriously by the National Conference leadership, although no official confirmation has been made. The decision on who will be the Speaker is expected to be finalized shortly before the session begins.  If elected, Rather will be tasked with leading the Assembly through an important and potentially contentious time, given the political shifts in the region.

LG Sinha’s Address To Set The Tone: Following the election of the Speaker, Lieutenant Governor Manoj Sinha is scheduled to deliver a comprehensive address to the Assembly. This address will outline the administration’s priorities, governance plans, and policy direction. As the de facto representative of the Union Government, the Lieutenant Governor’s address is expected to highlight key areas of development, including infrastructure projects, economic revitalization, employment generation, and security measures. The address will likely touch on the government’s vision for the next few years, with an emphasis on peace, stability, and development in Jammu and Kashmir. Sinha’s speech is expected to be closely watched by all political parties, especially in light of the ongoing debates over the Union Territory’s governance and its relationship with the central government. His address will set the stage for legislative discussions over the next few days.

Obituary References to Honor Late MLAs: On November 5, the second day of the session, the Assembly will turn its attention to paying tribute to former Members of the Legislative Assembly (MLAs) who have passed away since the last session. This solemn part of the session allows members to honor the contributions and legacy of the deceased leaders. It will also be an opportunity for newly elected members to reflect on the history and service of the former representatives. These obituary references are not just ceremonial but are a traditional and important part of legislative sessions in India.  They provide a moment for all members, regardless of party affiliation, to acknowledge the dedication and service of those who have contributed to the region’s governance. The tributes are expected to be heartfelt, especially since many of these leaders served during a very different political era in Jammu and Kashmir.

Debate On Motion Of Thanks To Focus On Regional Concerns: From November 6 to 7, the Assembly will engage in an in-depth discussion on the Motion of Thanks in response to the Lieutenant Governor’s address.  The Motion of Thanks is a critical part of parliamentary procedures, where legislators discuss the points raised in the Lieutenant Governor’s speech and express their opinions on the policies outlined. This debate will provide an opportunity for both the ruling coalition and opposition parties to voice their concerns, critiques, and support for the administration’s plans. The discussions are likely to be robust, as opposition parties, including the Bharatiya Janata Party (BJP), are expected to challenge the administration on various issues, ranging from development projects to governance and security. The newly elected members, including 51 first-time legislators, will have their first opportunity to participate in this key debate, which is expected to cover a wide range of regional concerns, such as unemployment, infrastructure development, security, and social welfare schemes.  This debate will also give the opposition a chance to scrutinize the policies put forth by the administration and bring attention to issues they believe have been neglected.

Final Day For LG Admin’s Response to Debate: On November 8, the final day of the session, the discussion on the Motion of Thanks will continue, with members expected to conclude their remarks. The Lieutenant Governor’s administration will then provide a formal reply, addressing the concerns and suggestions raised during the debate. This response is anticipated to be a comprehensive one, offering further details on the administration’s plans and strategies for addressing the region’s challenges. This reply will be a key moment for the administration, as it will outline how it intends to tackle the issues brought forward during the debate.  The government’s ability to respond effectively to opposition criticisms and suggestions will be seen as a reflection of its overall approach to governance in the Union Territory.

Crucial Role Of The First Speaker Of J&K UT: The role of the Speaker in this Assembly session will be more crucial than ever before. If Abdul Rahim Rather is elected, he will be stepping into a complex and challenging role, as the Speaker will have to navigate the unique circumstances of Jammu and Kashmir’s Union Territory status.  The Speaker will have the responsibility of maintaining order in the House, ensuring that debates are conducted fairly, and that legislative business is completed without unnecessary disruptions. Rather, with his extensive experience in both the legislative and executive branches of government, is well-equipped to handle these responsibilities. However, the challenges ahead are significant, as the Assembly will be dealing with a wide range of politically sensitive and contentious issues.

BJP In The Role Of Opposition In Assembly: The BJP, with 29 elected MLAs, is expected to take on a prominent role as the main opposition party in the Assembly.  Along with its potential allies, including five to-be-nominated members, the BJP will likely put up strong opposition to the National Conference-Congress government.  The party has already signaled its intention to hold the administration accountable on several fronts, including development projects, governance reforms, and law and order. The BJP’s presence in the Assembly is expected to bring a level of political intensity to the debates, particularly on issues related to national integration, security, and economic development.  The opposition will be looking to challenge the ruling coalition’s policies, and the debates are expected to be lively and, at times, heated.

BJP Eyes For Deputy Speaker Post: As per parliamentary tradition, the post of Deputy Speaker is likely to go to the BJP, given its position as the main opposition party.  This will give the party an additional platform within the Assembly to influence legislative proceedings and ensure that the opposition’s voice is heard. The Deputy Speaker’s role will be crucial in maintaining a balanced and fair approach during the legislative debates.

A New Chapter In J&K’s Legislative History: This Assembly session represents the beginning of a new chapter in Jammu and Kashmir’s legislative history. The political landscape has changed dramatically since the last session was held in 2014. With Jammu and Kashmir now functioning as a Union Territory, the dynamics within the Assembly will be different from those of a state legislature.
