Dr Mohammad Himayun, Assistant Professor of Pediatrics, had remained absent from duty since March 1, 2017.
Srinagar|Sept, 3: The Jammu and Kashmir government has terminated the services of Dr Mohammad Himayun, an Assistant Professor in the Department of Pediatrics at SKIMS Medical College Hospital, Bemina, citing his “willful and continuous unauthorised absence” from duty for more than nine years.
The Health and Medical Education Department issued the termination order on September 3, 2026, under Government Order No. 673-JK (HME) of 2026. The order said the termination would take effect retrospectively from March 1, 2017.
Himayun was appointed as a Lecturer in Pediatrics at SKIMS Medical College in 2009 and promoted as Assistant Professor in 2013, according to the order.
The government said he was earlier suspended in April 2015 for unauthorised absence from duty and was reinstated in December 2016 following due procedure. After his reinstatement, however, he attended duty for six days in January 2017 and three days in February before remaining absent from March 1, 2017, onwards.
A departmental inquiry was subsequently initiated. The inquiry officer, in a report submitted in June 2021, found that Himayun had been deliberately and willfully absent from duty, the order said.
The government also noted that Himayun had filed a writ petition before the High Court of Jammu and Kashmir and Ladakh, which was dismissed for want of prosecution in February 2024.
In September 2025, the department served him a pre-termination notice, giving him 15 days to explain why he should not be removed from service. His response cited health-related issues, family disputes, financial hardship and mobility-related difficulties.
The department, however, said the response did not rebut the findings of the departmental inquiry or establish a legally admissible justification for his prolonged absence.
The Finance and Legal sections of the department subsequently opined that the case warranted termination under Articles 113 and 128 of the Jammu and Kashmir Civil Service Regulations.
The order said a status report obtained from the Director, SKIMS, in February 2026 confirmed that Himayun had remained continuously absent since March 1, 2017, without reporting back for duty or seeking permission to rejoin.
“Continued unauthorised absence for over nine years” constituted abandonment of government service, the administration said, invoking the relevant provisions of the J&K Civil Service Regulations.
The government, accordingly, ordered termination of Himayun’s services on grounds of willful and continuous unauthorised absence, amounting to abandonment of government service.
