New Delhi| Aug,20 : Union Home Minister Amit Shah on Wednesday introduced three significant bills in the Lok Sabha, including a Constitution Amendment bill aimed at addressing corruption among high-ranking officials.
The Constitution (One Hundred and Thirtieth Amendment) Bill, 2025, proposes to remove Prime Ministers or Chief Ministers who are detained for 30 consecutive days due to allegations of corruption or serious offenses. The Jammu and Kashmir Reorganisation (Amendment) Bill, 2025, specifically seeks to amend section 54 of the Jammu and Kashmir Reorganisation Act, 2019. This amendment establishes a legal framework for the removal of a Chief Minister or Minister arrested on serious criminal charges, emphasizing the need for constitutional morality and good governance. Currently, the existing act lacks provisions for such removals.
The proposed amendment includes the insertion of section (5A), which stipulates that a Minister detained for 30 consecutive days on serious charges must be removed by the Lieutenant Governor upon the Chief Minister’s advice. If the Chief Minister fails to provide this advice within the specified timeframe, the Minister will automatically cease to hold office. Additionally, the amendment outlines that a Chief Minister in similar circumstances must resign within 31 days of detention. If they do not resign, they will also lose their position. However, the amendment allows for the possibility of reappointment as Chief Minister or Minister upon release from custody.
