A local court reserved orders on bail application of fake encounter accused

Srinagar/ April, 20: A local court in Srinagar has reserved order on a bail application of a fake encounter co accused after arguments were concluded by prosecution and defence.
A co-accused Farooq Ahmad Padder in fake encounter case of Abdul Rehman Padroo had moved a bail application in the court of Principal and Sessions Judge Srinagar saying that her daughter is getting married.
The other accused in the case included former Senior Superintendent of Police (SSP), H R Parihar, Deputy SP Bahadur Ram, Assistant Sub Inspector Farooq Gudoo, Manzoor Ahmad Malik and constable Bansi Lal
The Judge Rashid Ali Dar after hearing arguments from both defense and public prosecutor said that it would dispose off the bail application and reserved orders.
However, opposing the bail application, Public Prosecutor (PP) Advocate Syed Maqbool Ahmad referred to various Supreme Court judgments and other relevant provisions of law. He said the accused has committed heinous offence and his release on bail would send a wrong message to other criminals. He is the main accused person who abducted the victim under conspiracy to kill him, PP told the court. He also filed detailed written submissions of objections, vehemently opposing the bail application.
The court also allowed elder daughter of the victim to speak after she sought permission.
She said she is an orphan and her mother a widow because of the accused person and his release on bail would create law and order problem in south Kashmir since he is a murderer and does not deserve any leniency.
Referring to plea by the accused that his daughter is getting married, the daughter of the victim questioned what about those minor daughters who were rendered orphan by him. Our father will never return. We want justice to prevail, she pleaded.
Padroo, a carpenter from Larnoo Kokernag in Anantnag district, was killed in a fake encounter at Ganderbal in 2005. The court has recorded statements of about 84 prosecution witnesses in the case.
Investigating Officer (IO) Uttram Chand, who headed the Special Investigation Team (SIT) in 2007 had established that Padroo was killed in a fake encounter.
He had also deposed before the court that the evidence gathered during the investigation showed the involvement of seven accused Parihar, Ram, Gudoo,Farooq Padder, Malik and Lal.
Chand had said that they hatched a criminal conspiracy and were involved in the killing of Padroo who was also labeled as foreign militant.
