ACB produces charge sheet against BSNL Sub Divisional Engineer

Srinagar : Anti Corruption Bureau (ACB) Monday said that it has produced a charge sheet against Shamim Ahmad Shah, Sub Divisional Engineer, Transmission Division BSNL Srinagar and others in case of duping BSNL by setting up an illegal telephone network for making ISD calls.

ACB in a statement issued here on Monday said “ the Anti Corruption Srinagar Kashmir in Case FIR No.30/2007 under Section 5(1)(d) r/w 5(2) of J&K PC Act Svt. 2006 of PS ACB against one Shamim Ahmad Shah the then JTO BSNL now Sub Divisional Engineer Transmission Division BSNL Srinagar, one Roshan Lal Bhat (retired) the then Phone Mechanic BSNL and four other beneficiaries”.
The ACB statement also said the instant case was registered on the basis of a allegations that two brothers Shabir Ahmad Bhat and Ajaz Ahmad Bhat during their stay in Saudi Arabia in 2003 found that calls at cheaper rates are being made to different countries from Saudi Arabia. Stating that they found that an illegal telephone network exists in Saudi Arabia and explored prospects for this particular illegal telephone network in Kashmir and developed cognizance with the operators of the existing network, the ACB statement further said “ they
managed the access code of the BSNL Exchange from them with the a condition that they will provide two circuits to them as royalty”.

The ACB statement further said “the accused beneficiary Ajaz Ahmad Bhat roped in Shamim Ahmad Shah then JTO BSNL Exchange Sopore”, adding that “the accused Shamim Ahmad Shah accessed code successfully and an illegal call center was established at various places in Sopore in the year 2004. Then, with the transfer of accused JTO from Sopore to Kargil in the year 2005, the call the center was also shifted to Kargil in furtherance of criminal conspiracy in an organized manner hatched by the private persons with Junior Telecom Officer”.

The concluding para of the statement reads “subsequently, during the investigation, the call registries were seized and were examined for computation of call duration made to different
countries. On the basis of seized call registers, it was found that international calls of total 5689000 minutes duration was made from the five illegal call centers from Kargil. Further, it was found that the accused has been operating call centers at Kargil since 2005, as such, the call tariff chargeable on landline telephones in Kargil from 01.08.2005 to 14.05.2007 was sought from BSNL Corporate Office, New Delhi. During this period, the least call tariff of Rs. 6 per minute and The highest call tariff of Rs. 12 per minute was found applicable. BSNL has been deprived of the pecuniary benefit of more than 3 Crores, which is a consequential loss to the public exchequer/ BSNL authority for thethe year 2006-2007 .In view of the facts and evidence collected during the course of the investigation, charge sheet in case FIR No. 30/2007 of P/S ACB, Srinagar has been produced before the Hon’ble Court of Special Judge, Anti Corruption, Srinagar against the accused public servants namely Shamim Ahmad Shah, then JTO (Now Sub Divisional Engineer), Roshan Lal Bhat now retired, the then Phone Mechanic BSNL and accused beneficiaries namely Aijaz Ahmad Bhat, Shabir Ahmad Bhat, Mohammad Shafi Bhat and Naseer Ahmad Malik”.
