Residential projects to be charged ₹80 per sq metre, commercial buildings ₹270; common fee structure to be implemented by all Urban Local Bodies and Development Authorities with immediate effect

Srinagar, July 29: In a major step towards streamlining the building permission process, the Jammu and Kashmir Government on Wednesday notified a uniform Building Permission Fee Schedule applicable across all Municipal Corporations, Municipal Councils, Municipal Committees and Development Authorities in the Union Territory.

The Housing and Urban Development Department issued Government Order No. 157-JK(HUD) of 2026, bringing into force a common fee structure under the Jammu and Kashmir Unified Building Bye-Laws, 2021 (UBBL-2021) with immediate effect.

Under the new schedule, residential buildings, including housing colonies, will attract a building permission fee of ₹80 per square metre, while commercial, public/semi-public (PSP), industrial and other special category buildings will be charged ₹270 per square metre. Mixed-use buildings will be levied ₹150 per square metre.

The order further prescribes a malba (construction debris) security deposit of ₹3,000 for residential buildings and ₹10,000 for all other categories. A compounding fee equivalent to 40 per cent of the applicable building permission fee will also be charged in addition to the normal fee wherever applicable, while religious buildings have been exempted from paying building permission charges.

The government said the decision was taken after it was observed that different Urban Local Bodies and Development Authorities were charging varying building permission fees for similar categories of construction, leading to inconsistencies, procedural ambiguities and public grievances.

To ensure transparency, predictability and ease of doing business, the government has directed that the uniform fee schedule be integrated into the Online Building Permission System (OBPS)/Auto-DCR platform and implemented uniformly across the Union Territory.

The notification states that building permission fees shall be calculated on the basis of the total permissible or approved built-up area in square metres as provided under the Unified Building Bye-Laws, 2021.

The government has also prohibited any Urban Local Body or Development Authority from revising, enhancing, reducing or otherwise altering the notified fee structure without prior approval of the Housing and Urban Development Department.

Commissioners of Municipal Corporations, Vice-Chairpersons of Development Authorities and Chief Executive Officers and Executive Officers of Municipal Councils and Municipal Committees have been directed to ensure strict compliance with the new fee regime in their respective jurisdictions.
