A complaint was received by ACB from one Mohd Yosuf resident of Sumbal Bandipora alleging therein multiple instances of corruption, possession of disproportionate assets and illegal/ fraudulent appointments in Municipal committee Bandipora, Hajin & Sumbal by accused Abdul Rashid Shah & his nephew Javid Ahmad Shah.
On receipt of complaint & other information a secret verification was conducted by this Bureau which resulted in registration of four different cases against accused Abdul Rashid shah including three different cases of illegal/fraudulent appointments in MC Sumbal, Hajin & Bandipora & two cases against his nephew Javid Ahmad Shah the then Jr assistant NC Bandipora of fraudulent mutation & DA FIR.
The investigations in all three different cases of illegal /fraudulent appointments have been finalized by ACB & charge sheeted against accused Abdul Rashid Shah & others before court of law.
During investigations in the instant DA case FIR No 09-2013 it was found that accused public servant by indulging in corrupt practices has raised following assets/ expenditures during check period which were beyond known sources of income & for which he fails to account for; –
• Constructed a double Storied house at village Papchan Bandipora on ancestral land.
• Additional accommodation near the house at Papchan Bandipora.
• Purchase of land 01 kanal 04 marlas at Papchan Bandipora.
• Purchased a double storied house at Gazaliabad HMT Srinagar during check period.
• Purchased triple Storied Shopping Complex at Bandipora.
• Purchase of land measuring 2 kanal 10 marlas near Masjid Sharief at Takiyabal District Bandipora.
• Purchase of land 01 kanal at Papchan Bandipora.
• Purchase of land 02 marlas at Papchan Road Bandipora.
• Purchase of land 01 kanal and 17 marlas at Papchan Bandipora.
• Purchase of land 01 Kanal and 07 Marlas at Iqbal Colony Sidrha Jammu.
• Purchased 01 Kanal and 07 Marlas of land in the name of his wife Afrooza Begum at Sidhra bypass Jammu, plot No. 01.
• Purchased 01 Kanal, 06 Marlas and 111 sft of land in the name accused wife Afrooza Begum at Sidhra bypass Jammu Plot No. 02.
• Purchased 01 Kanal and 06 Marlas of land in the name of accused wife Afrooza Begum at Sidhra bypass Jammu, Plot No.03.
• Purchased 01 Kanal and 07 Marla’s of land in the name of accused wife at Sidhra bypass Jammu Plot No.04.
• A-Star Maruti Car.
Various expensive Movable items found during House search i.e TV. LG cine plus Radio Philips, T.V Videocon, Tube light, Philips court pent suits-10 items, Handicam sony,digital sony camera, Aquarium Transformer 10 kv, inverter with battery luminous, Refrigerator LG, washing Machine LG, Geyser venus  along with Stabilizer, Shawl pashmeena, computer, mixer Grinder, brief cases-4 number etc. found during house search with other items.
Balance in the Accounts maintained at J&K Bank Branch Bandipora J&K Grameen Bank Branch Bandipora, J&K Grameen Bank Branch Nadihal, PNB Bank Srinagar.
Expenditure made on purchase of Gold Ornaments from Kadla Jewellers Jamia Market Nowhata Srinagar, on renovation of residential houses as well as expenditure incurred on purchase of verifiable items and on education of children & other services availed,Fix deposits etc.
On culmination of the investigations Charge Sheet  in the case was presented against the accused Peerzada Abdul Rashid Shah S/o Noor-ud-Din Shah R/o Papchan, the  Executive officer MC Sumbal, Hajin & Bandipora for commission of the offence punishable under Section 5(1) (e) r/w sec  5 (2) of the Jammu and Kashmir Prevention of Corruption Act, Svt. 2006, U/sec  12/14 of the Public Men and Public Servants (Declaration of Assets and Other Provisions) Act, 1983  r/w Section 109 of the Ranbir Penal Code & against the co-accused persons, namely 1.  Afroza Bano W/o Abdul Rashid Shah R/o Papchan Bandipora, 2. Saif Ud Din Baba S/o Ghulam Mohi-ud-Din Baba R/o Doniwari Kupwara, and 3. Sameer Ahsan Shah S/o Mohammad Ahsan Shah R/o Ward No. 09, Papchan Bandipora, for the offence punishable under Section 109 of the RPC.
Next date of hearing has been fixed on 28, April 2026
