Black marketing and hoarding triggering a huge row in the aftermath of the recent tragedy on Kashmir highway in Ramban district of Jammu province has undoubtedly evoked a strong response from non else than the Chief Minister Omar Abdullah himself but unfortunately the insistence for a legal framework from the bureaucratic top brass of the Food, Civil Supplies & Consumers Affairs (FCS&CA) Department is not being taken seriously by the elected Government. For all practical purposes it is for the elected Government to either take a call on legal framework or issue an executive order for revival of decades old market checking practices by the enforcement wing of the FCS& CA Department. Unfortunately the claim of the bureaucratic top brass of the FSC&CA Department that there is no legal framework governing the market checking of essential commodities in Jammu and Kashmir is not being taken as serious as it should have been taken by the elected Government. Interestingly the history of the law enforcement wing of the department itself contradicts the very claim of the top authorities of the department. A striking example of such an intervention occurred just few months ago when Divisional Commissioner Kashmir took strong exception to an arbitrary price hike in local breads. The Government intervened, reduced the price of local breads from Rs 10 to Rs 7 per piece, a move that reaffirmed its ability to regulate the cost of essential commodities. If the Government can intervene in market prices, then the FCS&CA Department’s denial of its legal mandate over market checking appears both misleading and contradictory. Shockingly the FCS&CA Department again went on a denial mode when it came to revival of market checking on the eve of Eid Ul Fitre just a fortnight ago as top authorities again insisted for a call on legal framework for revival of market checking practices by the enforcement wing of the department. This inconsistency creates confusion and raises concerns about whether bureaucratic top brass of the department is deliberately evading its responsibilities. If regulatory mechanisms are indeed in place, why does the bureaucratic top brass of the department continue to insist that it lacks the authority to enforce them? The elected Government under the leadership of Chief Minister Omar Abdullah must establish clear guidelines to prevent further misinterpretation of legal mandates. If any legal loopholes exist, it is the responsibility of the elected Government to address them through necessary amendments and executive orders.
