Srinagar : The Bharatiya Janata Party (BJP) on Monday termed the resolution brought by Peoples Conference president and MLA Handwara Sajad Gani Lone for the restoration of Article 370 and Article 35-A as “unconstitutional,” stating that decisions taken by the Parliament cannot be reopened in the Assembly of the Union Territory.
The BJP chief spokesman Advocate Sunil Sethi on Monday told a local news gathering agency “It is against the constitution as decisions taken by the Parliament cannot be reopened in the Assembly.”
While Kashmir-based opposition parties are likely to back the resolution, all eyes will be on the stance of the ruling party and the Speaker. Lone had last week submitted a resolution in the Assembly secretariat seeking the restoration of the pre-August 5, 2019 constitutional position. The resolution also condemns the abrogation of Article 370, Article 35A, and the Jammu & Kashmir Reorganisation Act in the strongest terms. Lone, the most vocal critic of the NC-led government, has maintained that the resolution brought by the National Conference-led government in the first session of the House was ambiguous and did not clearly reject the August 5, 2019 decisions
