Exploitation Of Ballot For Bail

“ A politician glorifying elections for both winning an election and as well as getting the bail in any case of crime or corruption is in fact spoiling the basic spirits of public representation by exploiting the power of ballot.”

It is routine practice for politicians in both Jammu & Kashmir and as well as at the centre and in most of the states and union territories of the country that politicians jailed for crime or corruption glorify elections not only for winning the election but also for getting the bail. Politicians may take sadistic pleasure in giving legitimacy to this bad trend but ultimately it is an insult to the institutions of public representation and public services in the eyes of majority of populations both within and outside Jammu & Kashmir. Now when the Supreme Court of the country has said that “Bail Is The Rule And Jail An Exception” no one particularly politicians should be scared of the facing judicial trial and instead tend to get bail gracefully through a legal procedure by following well established practices and procedures of the judicial system. A politician glorifying elections for both winning an election and as well as getting the bail in any case of crime or corruption is in fact spoiling the basic spirits of public representation by exploiting the power of ballot. After all why should only a politician get a license to get bail in a case of crime or corruption  and a common man not get it for casting vote in election periods but instead follow the given practices and procedures of law for getting the absolute bail. So politicians tending to get the bail under the garb of elections both within and outside Jammu & Kashmir owe a lot of explanations both to people and as well  to the investigative agencies on this count. In the recently held Lok elections the Supreme Court of the country was flexible enough to grant bail to several politicians like Delhi Chief Arvind Kejriwal but did not extend such a bail beyond election deadline obviously to ensure that power of ballot is not misused and exploited to spoil the institutions of investigation and judicial trial.

“Just like Supreme Court has said that “Bail Is the Rule, Jail An Exception” the political parties across the country should declare it that bail during the election periods won’t be allowed to become the new norm of politics in Jammu & Kashmir or in anywhere else in the country be it Delhi or any other state or union territory. After all the probity in public life can’t be established by exploiting the ballot for winning elections and securing temporary bails but by following given practices and procedures of law set for the grant of bail in cases of crime and corruption.”

Interestingly Manish Sisodia a former Deputy Chief Minister Of Delhi who too belongs to Kejriwal’s Aam Admi Party got the bail after the elections and Manish Sisodia remaining in jail during the election period did not change the electoral prospects of Aam Admi Party in any way. Just like Supreme Court has said that “Bail Is the Rule, Jail An Exception” the political parties across the country should declare it that bail during the election periods won’t be allowed to become the new norm of politics in Jammu & Kashmir or in anywhere else in the country be it Delhi or any other state or union territory.
