Which expenses should be disclosed and which should remain undisclosed in alimony proceedings?

Introduction: The term Alimony is derived from the Latin word “almonia” which means sustenance and the term almonia is derived from the word “alere” which means to nourish. So the Alimony may be defined as financial support that a person is ordered by a court to give their spouse during separation or following divorce. It was first the code of Hammurabi which tosses a light on the notion of alimony, declares that a man must provide sustenance to a woman who has borne him children so that she can raise them. Later the modern concept of alimony is derived from the English Ecclesiastical courts( court spiritual).
Role Of Expenses In Alimony/ Maintenance: Expenses play a significant and pivotal role in determining maintenance awarded to the wife. The court considers various factors comprising the wife’s financial and budgetary needs and the living standard before awarding the maintenance. Unveiling of expenses holds a paramount impact on final order of maintenance. Where the disclosing of expenses have favourable impact, non-disclosure may affect the overall proceedings of maintenance in an unfavourable and unpleasant way towards the husband while granting alimony to the wife. The amount of support is not fixed and contrasts with each case to how much maintenance ought to be paid to the spouse. The amount is decided by the court keeping in thought the relevant and significant components like husband earrings,property, expenses, property ownership and conduct of both the parties. Deliberation of expenses for awarding alimony relies mainly on the Essence of expenses, Whether there is involuntary or voluntary deduction in the expenses. The Fundamental of deduction has a great role in diminishing or expanding the amount of maintenance. Voluntary deduction refers to those payrolls deduction that an employee opt into. It may include insurance premium and retirement savings. On the other hand involuntarily deductions refer to those payrolls which are mandatory and legally required for an employee.
Expenses which should be disclosed and which should remain undisclosed. From the above consideration we can say that In alimony proceedings, transparency and fairness are paramount. While the party may have personal references regarding which expenses should be disclosed or remain undisclosed, courts typically establish guidelines to ensure equitable outcomes.
Expenses that should be disclosed:
1. Income: At first, the party should disclose his current income which includes salaries, bounces, investments, rental income and any other source of capital. The transparency helps to consider the party’s financial situation.
2. Living expenses: living expenses like housing costs, electricity bills, transportation, groceries, and health care essential should be disclosed. These essential living expenses may help the court in determining the favourable amount of maintenance.
3. Debts and obligations: Debts such as car loans, EMI, credit card debt, and other financial obligations must be disclosed. This disclosure helps the court to determine the party’s financial liabilities and their ability to meet their financial obligations post maintenance.
4. Taxes: The party should provide the details of taxes such as property taxes, income taxes and other relevant tax information. The same information helps the court for awarding accurate alimony amounts.
5. Financial Assets: Financial assets such as bank accounts, real estate properties and other valuable assets should be disclosed. The non disclosure of the same will lead to serious consequences in alimony proceedings.
6. Dependent Parents ( If Any): It is a duty of man to take reasonable care of his parents and to provide basic amenities to the parents which includes medicines, groceries, health checkups, adequate diet. So if the man has dependent parents and the expenses for their reasonable care should be disclosed. The same disclosure plays an important and crucial role in awarding the Alimony to the wife. In the recent case of Sarita bakshi vs state and ors(2022),the court allowed the father of the husband who is 79 years old and dependent on son as a legitimate and considers his share to be deducted.
7. Seperated and unmarried sister. In the same case of Sarita Bakshi vs State and Ors, the court observed that it is a moral liability of the brother to take reasonable care and provide adequate amenities to the divorced sister. In this case it was held that share of divorced sister were also considered as a deduction.

“Expenses directly linked to supporting dependents, such as healthcare, etc should be disclosed to accurately assess financial needs. Conversely, discretionary expenditures unrelated to dependents’ welfare, like entertainment or luxury items, may remain undisclosed to maintain privacy and prevent unnecessary intrusion into personal matters. Striking a balance between disclosing essential expenses for fair evaluation and respecting individuals’ privacy rights is crucial for upholding justice and dignity in alimony proceedings.”

Expenses That Should Remain Undisclosed:
1. Discretionary Expenses : The expenses which consist of entertainment, vacations and luxury purchases should remain undisclosed. The disclosure of the same may affect the husband in alimony proceedings in an unpleasant and negative way.
2. Future Earning Potential: while current income is disclosed, future Earning potential should not be disclosed unless it depicts that the future earning will affect the liabilities of the husband.
3. Personal Expenses: There are certain expenses which a person utilises for himself such as gifts, personal hobbies and non essential subscriptions and memberships. There are other following factors which may help to reduce the amount of maintenance. Such facts are as follows:
1) If the wife is working, then the amount can be quite less.
2) If the wife owns a property, the amount can further be reduced (Section 25(1) of HMA).
3) Your Other Liabilities: house rent, medical bills for the amount spent on the treatment of your parents, liabilities towards sister(s), loan payments, provident fund, tax, etc.
4) Adultery or remarriage (Section 25(3) of HMA and Section 125(3) of CrPC) will lead to cancellation of maintenance.
5) Without any sufficient reason, the wife refuses to live with her husband (Section 125(4) of CrPC).
6) Both are living separately by mutual consent (Section 125(4) of CrPC).
Conclusion: In conclusion, transparency is essential in alimony proceedings to ensure fair and equitable outcomes. Expenses directly linked to supporting dependents, such as healthcare, etc should be disclosed to accurately assess financial needs. Conversely, discretionary expenditures unrelated to dependents’ welfare, like entertainment or luxury items, may remain undisclosed to maintain privacy and prevent unnecessary intrusion into personal matters. Striking a balance between disclosing essential expenses for fair evaluation and respecting individuals’ privacy rights is crucial for upholding justice and dignity in alimony proceedings
