New Delhi: The All India Muslim Personal Law Board (AIMPLB) on Sunday authorized its president to initiate measures to ensure a roll-back of the Supreme Court judgment on compulsory maintenance of divorced Muslim women.
The Board, at its meeting in New Delhi chaired by President Hazrat Maulana Khalid Saifullah Rahmani, resolved that the recent Supreme Court judgment on the maintenance of Muslim divorcee women was against Islamic law (Shariah).
The AIMPLB emphasized the importance of marriage continuity as per the Holy Quran and said it was impractical to force men to maintain ex-wives after divorce.
The meeting’s proceedings were conducted by General Secretary Maulana Muhammad Fazlurrahim Mujadidi and it was attended by delegates from across the country.
The Board opposed the implementation of a Uniform Civil Code in India, arguing it was against the constitutional rights of minorities.
It resolved to challenge the UCC in Uttarakhand and directed its legal committee to file a petition.
The Board stressed that in a multi-religious country like India, religious entities have the right to practice their own laws, such as the Sharia Application Act 1937 for Muslims.
The Board demanded the protection and proper management of waqf properties, highlighting encroachment by state and central governments.
The Board expressed concern over the government’s failure to provide security to Muslims and lower-caste citizens, linking it to the recent election results. It warned that continued disregard for the rule of law could lead to anarchy and tarnish India’s reputation.
The Board criticized lower courts for entertaining new disputes related to the Gyanvapi masjid and Shahi Eidgah of Mathura. It urged the Supreme Court to uphold the “Places of Worship Act, 1991” and protect heritage mosques, cautioning against any attempts to demolish or alter them.
