In a significant move aimed at promoting inclusivity and addressing historical imbalances, the Indian Parliament has passed the Jammu and Kashmir Reservation (Amendment) Bill, 2023, and the Jammu and Kashmir Reorganisation (Amendment) Bill, 2023. While the Lok Sabha approved the Bills last week, the Rajya Sabha also gave its nod marking a crucial step in the legislative process. Jammu and Kashmir Reservation (Amendment) Bill, 2023: The amendment to the Jammu and Kashmir Reservation Act, 2004, seeks to bring about crucial changes in the reservation criteria. The existing Act provides reservation in employment and educational institutions for Scheduled Castes, Scheduled Tribes, and other socially and educationally backward classes. The Bill replaces the term “weaker and underprivileged classes” with “other backward classes” as declared by the Jammu and Kashmir Government, reflecting a nuanced approach to social justice. Jammu and Kashmir Reorganisation (Amendment) Bill, 2023 focuses on amending the Jammu and Kashmir Reorganisation Act, 2019. The 2019 Act had altered the Second Schedule of the 1950 Act to specify that the total number of seats in the Jammu and Kashmir Legislative Assembly would be 83. The new amendment increases the total number of seats to 90, with specific reservations – seven for Scheduled Castes, nine for Scheduled Tribes, and the provision for the Lieutenant Governor to nominate up to two members from the Kashmiri migrant community, with at least one being a woman.

The Jammu and Kashmir Reservation (Amendment) Bill, 2023, and the Jammu and Kashmir Reorganisation (Amendment) Bill, 2023, bring about several benefits, aiming to foster social inclusivity, equitable representation, and overall development in Jammu & Kashmir.”

Key Remarks by Union Home Minister Amit Shah: Responding to the parliamentary debate, Union Home Minister Amit Shah reiterated the constitutional validity of the decision to abrogate Article 370, stating that the recent Supreme Court verdict validated the move. He argued that Article 370 had promoted separatism and terrorism in Jammu and Kashmir.  Shah also affirmed the commitment of the Narendra Modi government to restoring statehood to Jammu and Kashmir and conducting elections at an appropriate time. Highlighting the changes brought about by the new delimitation commission, Shah noted that the number of seats in Jammu had increased from 37 to 43, and in Kashmir, from 46 to 47. Additionally, 24 seats have been reserved for Pakistan-occupied Kashmir, with Shah asserting India’s claim to the region. Discussing the security scenario, the Home Minister pointed out a substantial reduction in militancy related incidents and organized stone-pelting over the last decade. He claimed a 70% decrease in militancy related incidents, from 7,217 during the UPA rule to 2,197 in the past ten years. Shah also highlighted the decline in organized stone-pelting incidents from 2,656 in 2010 to none in the present year. Emphasizing the government’s efforts to curb militant funding, Shah underscored a substantial reduction in incidents of ceasefire violations, from 70 in 2010 to six in 2023. In conclusion, the passage of these bills reflects the government’s commitment to addressing socio-economic disparities and ensuring the equitable representation of various communities in Jammu and Kashmir, while also reiterating its dedication to the region’s development and stabilisation of peace. The Jammu and Kashmir Reservation (Amendment) Bill, 2023, and the Jammu and Kashmir Reorganisation (Amendment) Bill, 2023, bring about several benefits, aiming to foster social inclusivity, equitable representation, and overall development in Jammu & Kashmir.

Inclusive Representation: The amendments to the reservation laws prioritize inclusivity by replacing the term “weaker and underprivileged classes” with “other backward classes.” This change reflects a more nuanced and inclusive approach to identifying and addressing social and educational backwardness in Jammu and Kashmir.

Enhanced Political Representation: The increase in the total number of seats in the Jammu and Kashmir Legislative Assembly from 83 to 90 allows for better political representation. Specific reservations for Scheduled Castes and Scheduled Tribes, along with the provision for the nomination of members from the Kashmiri migrant community, contribute to a more diverse and representative political landscape.

Empowerment of Marginalized Communities: By reserving seats for Scheduled Castes and Scheduled Tribes, the legislation ensures that marginalized communities have a dedicated and proportional representation in the legislative process. This empowerment is crucial for promoting social equality.

Recognition of Kashmiri Migrants: The provision allowing the Lieutenant Governor to nominate up to two members from the Kashmiri migrant community, with one being a woman, acknowledges the unique challenges faced by this community. It provides them with a voice and representation in the legislative assembly.

Constitutional Validity: The affirmation by Union Home Minister Amit Shah regarding the constitutional validity of the decision to abrogate Article 370 and the subsequent Supreme Court verdict provides legal clarity. This assurance strengthens the government’s stance on the constitutional legitimacy of its actions, contributing to political stability.

Security Improvements: The Home Minister’s remarks on the significant reduction in militancy related incidents, non stop cycles of stone-pelting, and ceasefire violations underscore the positive impact of government policies on security in the region. National Integration: By emphasizing India’s claim to Pakistan-Administered -Kashmir and asserting that it belongs to India, the incumbent Central Government reinforces the principles of national integration and sovereignty.

Implement policies that balance economic growth with ecological preservation.
