Gangtok: India’s Ministry of Home Affairs on Monday filed a review petition in the Supreme Court, against some of the observations and directions in a recent Judgement of the apex judiciary that referred to persons of foreign origin settled in Sikkim
The Observations in the January 13 order pertaining to two petitions filed by the Association of Old Settlers of Sikkim contained some comments that Monday’s petition wanted to be reviewed.
“Ministry of Home Affairs (MHA) files review petition in Supreme Court against some of the observations and directions in a recent judgement dated 13th January, 2023 in two petitions of 2013 and 2021 filed by Association of Old Settlers of Sikkim and Ors in Supreme Court.
“GoI reiterated its position about the sanctity of Article 371F of the Constitution that safeguards the Sikkimese identity, which should not be diluted,” the union home ministry said on its official Twitter handle.
“Further, the observation in the said order about persons of foreign origin settled in Sikkim like Nepalis should be reviewed as the said persons are Sikkimese of Nepali origin,” the ministry said in another tweet.
Sikkim State BJP President, Dilli Ram Thapa, MLA, said it was a day to rejoice for the Sikkimese people.
‘We were unhappy and met Union Home Minister Amit Shah on Sunday. But he had already started on it and got a review petition filed on Monday. Shah ji is thanked by State BJP, Sikkimese Nagrik Samaj and Joint Action Committee for it,” he said.
Sikkim Chief Minister PS Tamang, now camping in Delhi, called on Lok Sabha Speaker Om Birla,at Parliament House during the day.
Birla has assured his full support also safety and protection of all Sikkimese, as provided under the Constitution of India. UNI
