H&ME terminates six doctors for unauthorised absence

Srinagar: Health and Medical Education Department on Thursday terminated six doctors for unauthorised absence while 11 others have been asked to join duties within 21 days subject to sign a bond that they will serve in J&K for at least 5 years.
The doctors who have been terminated include Dr Mudasir Bashir of Batamaloo Srinagar, Dr Muzaffar Mohidin Hakeem of Palhalan Pattan, Dr Shazia Kausar of Rajbagh Srinagar, Dr Ubaid Ali of Chanapora Srinagar, Dr Nowsheen Mir of Hyderpora Srinagar and Dr Imran Khan of Kursoo Rajbagh.
According to the order these doctors neither replied to Final notice nor reported back for duties except Dr. Ubaid All who after completion of course had signed compulsory bond with the Karnataka Government to work there till January 2023, without any intimation to Health & Medical Education Department.
“Willful absence from duty after the expiry of leave renders a Government servant liable to disciplinary action and absence without leave or after the end of leave involves loss of appointment, except as provided in Article 203 (b) or when due to ill health in which case the absentee must produce the certificate of Medical Officer and cases of these doctors have been examined thoroughly in the department in view of the rule position governing the subject and it has been found that since these doctors have not resumed their duties despite notices issued to them and this act on their part is a voluntary act and they are liable to be discharged from services on account of unauthorized absence from duties for more than five years.” It adds.
Meanwhile 11 other doctors namely Dr Tariq Abdullah of Kuthair Anantnag, Dr Mudasir Muzamil of Sonawari Bandipora, Dr Shahid Hameed of Shadimarg Pulwama, Dr Malik Suhail of Doru Anantnag, Dr Adil basher of Kanthbagh baramulla, Dr Ahmed Wajeed Yousuf of Malla Bagh Hazratbal Srinagar, Dr Shabir Ahmad Mir of Wagar Khansahib Budgam, Dr Mufeed Ahmad Bhat of Kamad Anantnag, Dr Iftikahr Ahmad Dugga of Nai Basti Khanabal Anantnag, and Dr Rayees Ahmad of Kuder Kulgam have been given a time of 21 days.
However, as per separate order, these doctors can resume services within 21 daus by giving a written bond that they will serve in Jammu and Kashmir for five years and provide an undertaking that they are not involved in subversive activities and are not employed in anywhere.
“The case of these doctors were examined in the Department and in the interest of patient care, it has been decided that the doctors who have submitted their joining report/reply in the Directorate of Health Services, Kashmir/Administrative Department in compliance to the notices served upon them, be allowed to resume their duties,” the order states.
Sanction is hereby accorded to allow the doctors to re-join within a period of Twenty one (21) days in the Directorate of Health Services, Kashmir to resume their duties, with prospective effect, subject to the conditions that these doctors are/were not involved in any subversive activities as well as not employed in any other Government/private sector during the said period, for which an affidavit duly authenticated by the 1″ Class Judicial Magistrate shall be obtained by the Directorate of Health Services Kashmir, from the doctor concerned and they shall given in writing (in the shape of bond) that they will serve the UT of J&K, at least for a period of five (05) years.” It adds.
“The period of their un-authorized absence shall be decided separately,” the order reads
