Srinagar: A case has been registered against a man in north Kashmir district of Kupwara under the Muslim Women (Protection of Rights on Marriage) Act-2019, which prohibits divorce by pronouncing talaq three times by husbands of married Muslim women.
The case was registered after the woman, identified as Tahira Begum, approached a local court and sought FIR against her husband Rafaqat Ahmad Lone, a resident of Mundya Nagam, Keran in Kupwara.
This is the first case registered in Kashmir valley under the act that was passed by Parliament in 2019. The Act makes all declaration of talaq, including in written or electronic form, to be void (i.e. not enforceable in law) and illegal.
Official sources said that in the complaint the woman stated that she got married to Lone few years back. The woman alleged that she has been facing domestic violence and was recently given three times verbal talaq by her husband.
“On the directions of the court, a case against the accused has been registered under section 4 of the Muslim Women (Protection of Rights on Marriage) Act 2019,” they said.
They said if proven guilty, the accused is liable to be punished by imprisonment up to three years and fine. “A domestic violence case has already being registered against the accused in December 2020. The case is under trial in the court,” they said.
