New Delhi/Feb, 24:Central Government may change its position on article 35 A during hearing on Article 35 A in the ensuing week beginning Monday(tomorrow), reported times of India on Sunday.
Quoting sources the report said Centre may change its position on article 35-A during hearing in the supreme court in the ensuing week beginning Monday(tomorrow) and move an ordinance to scrap article 35-A A. The article 35-A giving special property rights to the people of Jammu and Kashmir is being challenged by an NGO “We the people” and many groups including the Kashmir High Court Bar Association (KHBA) and some individuals are the intervenes in the case. The central government has instead of defending article 35-A sought adjournments in the previous hearings and despite several insistement from the previous PDP-BJP coilition government it did not file an affidavit to defend the article 35-A The Jammu and Kashmir Government is defending the case and has engaged many top lawyers including leading constitutional expert Fali S Narima for defending the case in the apex court if the country. Any attempt to scrap article 35-A could lead to a massive public unrest in Kashmir where Joint Resistance Leadership comprising Syed Ali Shah Geelani the Hurriyat Conference (G) Chairman Mirwaiz Molvi Umar Farooq the Hurriyat Conference (M) Chairman and Mohammad Yasin Malik the JKLF Chairman and mainstream regional parties National Conference and PDP have threatened mass uprising against any attempt to fiddle with Article 35-A.
