If the Governor Satya Pal Malik’s remark in which national English Daily “Indian Express”  quotes him as saying “the current dispensation in the state is not an elected government”, and this is not the right time for parties to take a position on Article 35A or Article 370”, is to be believed then the intents of both the incumbent central government and as well as the state government come into question on many counts. The remarks owes explanations for the reason that Governor’s remark very clearly shows disrespect to the public sentiment generated by the legal challenge to article 35-A in the supreme court of the country. No better a person than the governor of the state can have a credible assessment of the unprecedented unity shown by the people of all the three regions on the protection of article 35-A. Instead of giving due respect to the emotions of the people of the state on the protection of article 35 the governor is reported to have said that this is not the right time for the government to take a legal position on article 35 A . Governor saying that holding elections are important than debating article 35 A means that like central government he too wants to buy time till commencement of Lok Sabha election to give an opportunity to BJP to use article 35 A row as a trump card in 2019 Lok Sabha Elections.

Seeing a lot of  similarities in the words of Tushar Mehta the Additional Solicitor General of India presently also Jammu & Kashmir Government’s counsel for defending article 35 A in the supreme court and the action of governor Satya Pal Malik the people in Kashmir reserve the right to show non cooperation in the conduct of Panchayat and municipal elections proposed to be held shortly in the state

If this is the position governor wants to take at the whims and wishes of the BJP then people of Kashmir must salute state BJP President Ravinder Raina who has already said “ Naya Governor Apna Bandha Hai” means “ Governor is our own man”. Above all governor’s statement is also reflected what  Additional Solicitor General of India Tushar Mehta while appearing on behalf of the Jammu & Kashmir Government told the Supreme Court on August 31 and people  of Jammu & Kashmir won’t  forget Mehta for having said  “even debate or discussion on Article 35A will have serious repercussions on law and order and local bodies elections are to be held in Jammu & Kashmir”. Mehta’s more unforgettable remark is that “article 35 A is a gender discrimination case”.  Interestingly the Jammu & Kashmir Government has not refuted any controversial argument of Tushar Mehta despite condemning of his controversial arguments by both National Conference and PDP.  Seeing a lot of  similarities in the words of Tushar Mehta the Additional Solicitor General of India presently also Jammu & Kashmir Government’s counsel for defending article 35 A in the supreme court and the action of governor Satya Pal Malik the people in Kashmir reserve the right to show non cooperation in the conduct of Panchayat and municipal elections proposed to be held shortly in the state.
