Rape-n-murder the crime, capital punishment the response

Rape and murder of Kathua minor girl Asifa was heinous crime that should not have happened and the ordinance promulgated by the President of India to allow courts to award capital punishment to people committing raps on child less than twelve (12) years age is the response of the central government. Though Jammu & Kashmir government should have taken the lead over the central government in passing an ordinance against the rape accused convicts for the reason that the heinous crime which evoke condemnation and criticism from people of shades both within and outside India but the central government commanded and controlled by Narendra Modi led BJP choose to take the lead in passing the widely welcomed ordinance to ward off the mounting international pressure over the rape and murder of an eight year old girl in Jammu & Kashmir’s Kathua district. Though it is a fact that perhaps for the first time in the world history United National General Secretary issued a statement over the rape and murder of any individual but shocking BJP leaders sharing power with Mehbooba led PDP in Jammu & Kashmir raised questions over the probe conducted under the supervision of the Crime Branch of Jammu & Kashmir police and demanded the handing over of the investigation of the case to Central Bureau of Investigation (CBI) the central government’s investigation agency once called “ caged parrot” by the Supreme Court of the country. Ironically the disgruntled BJP leaders kicked out from Mehbooba’s cabinet by party’s central high command under mounting criticism within and outside the country on tending to show selectivity in choosing the investigative agency for the prove the sacked ministers of the party continue crying over the demand for CBI inquiry despite Prime Minister Narendra rebuking BJP law makers for making the controversial statements.

Since the investigation is conducted by the Crime Branch of Jammu & Kashmir police under the supervision of high court and the agitating lawyers of Jammu Bar Association have taken a U-turn over demand for CBI inquiry there is no point for the BJP leaders including the likes of Lal Singh to continue crying over the CBI inquiry after a clinching evidence has been given by the Delhi Forensic Laboratory but not the Jammu & Kashmir Forensic Science Laboratory.

The BJP leaders accusing Crime Branch investigators of trying to falsely implicate in the Kathua rape and murder case must also have the moral courage to side with those Kashmir who alleged false implication of many people in many cases by the central government’s investigative agencies. Even this time many people arrested on different charges last year are raising questions over the investigation conducted against them by the National Investigative Agency (NIA) and the Enforcement Directorate both controlled by the Union Home Ministry but PDP though an ally of BJP dared to raise questions over the investigations conducted by NIA and the Enforcement Directorate. BJP leaders seeking CBI inquiry should hang their heads in shame over the way they opposed the demand for suspension of a police officer who by virtue of his actions was caught on wrong foot and consequently named accused in the case. Since the investigation is conducted by the Crime Branch of Jammu & Kashmir police under the supervision of high court and the agitating lawyers of Jammu Bar Association have taken a U-turn over demand for CBI inquiry there is no point for the BJP leaders including the likes of Lal Singh to continue crying over the CBI inquiry after a clinching evidence has been given by the Delhi Forensic Laboratory but not the Jammu & Kashmir Forensic Science Laboratory.
