Judicial course for hurting public sentiment

Fanatic hindus are attempting to hijack democracy now a days in India the country which feels proud of being the second largest democracy in the world. To scrap or strengthen the article 370 and related legislations guaranteeing special status to Jammu & Kashmir state is though the job of the elected representatives of the parliament and Jammu & Kashmir assembly but enjoying the cloud of Modi government the political and noncore affiliates BJP tend to take the judicial route to scrap the legislations passed by the parliament and Jammu & Kashmir assembly. By doing so the political and non political affiliates of BJP are showing mistrust in the working of the parliament the highest law making body of the country and the Jammu & Kashmir assembly the symbol of democracy in Jammu & Kashmir state. As the decision of the Apex Court over the Article 35-A is likely to come within a month, the Supreme Court of India on Tuesday admitted a plea challenging the legality of Article 370, which provides special status to Jammu and Kashmir. Attempt to integrate Jammu & Kashmir with the Union of India through judicial routes can’t change the political sentiment in Kashmir which could not be changed even by holding elections from time to time for running the routine affairs of the government in the state. Even if courts scrap either the article 370 or related legislations like article 35 A governing property rights act in the state the struggle against the imposition of central laws won’t die down for the reasons that central laws are extended to Jammu & Kashmir state against whims and wishes of the people living their lives in a fearful atmosphere for the last seventy years.

The pleas taken by the political and non political affiliates of BJP in facts are one way and other way challenging the relevance of the entire constitution under which the elections are being held for the last seventy years. BJP’s political and non political affiliates have to ponder over the pleas they take to challenge article 370 and related legislations like article 35 A as lapsing of one provision of constitution can also mean lapsing of the whole constitution.

While BJP finds it difficult to push its controversial political agenda down the throats of the people in Jammu & Kashmir, the regional mainstream political parties find its easy to generate public support for the struggle against the extension of central laws to the state and this is sufficient enough an indication that people are unwilling to endorse the BJP’s policy of demolishing special status of the state through judicial routes. Laughable it is that the political and non political affiliates of the BJP have taken a plea before the supreme court that article 370 has lapsed and henceforth the separate constitution of Jammu & Kashmir be declared illegal but question can be asked that if one provision of the constitution of India has lapsed then question on the lapsing of other provision of the same constitution can be raised.
