The warning to central government by both the united mainstream opposition comprising National Conference (NC), Congress, CPI-M and Peoples’ Democratic Front (PDF) and the joint resistance leadership on tinkering with article 35 A is a grim remind to the Modi government about its responsibilities on protection of the special status granted to the state under article 370 of the constitution of India. So for Modi government has shown highly irresponsible and objectionable response to the petition filed in the supreme court of the country to challenge article 35 A governing property rights act in Jammu & Kashmir state. The decision to follow a joint strategy by the united mainstream opposition comprising National Conference (NC), Congress, CPI-M and Peoples’ Democratic Front (PDF) and call for shutdown against central government’s repeated tinkering with the article 35 A is a message to Delhi that people of all shades irrespective their ideologies excepting BJP are on the same page on protection of special status and all legislations connection with article 370. Surprisingly BJP is half heartedly extending assurances on protection of article 370 as the party leaders publicly say that alliance with PDP stops BJP from supporting abrogation of article 370 and all legislations connected with the special status of the state. Had the BJP been concerned about the standards of political ethics in the fastly changing political scenario in the country the party won’t have allowed its political and non political affiliates to file petitions for challenging some key legislations in the supreme court of the country. The attempts of the BJP to weaken article 370 and key legislation s connected with the special status of the state through its political and non political affiliates have been now exposed as the Modi government’s Attorney General recently refused to file a response to the petition filed by a non governmental organization (NG) to challenge article 35 A governing the property rights act in the state Though undeniable fact is that abrogation of article 370 is part of the core political agenda of BJP but equally undeniable fact is also the commitment of BJP to protect article 370 reflected in the agenda of alliance (AoA) signed with PDP for running the affairs of the Jammu & Kashmir government.
Situation demands that Modi government revises its legal course on the controversial petitions filed in the Supreme Court against article 370 and other key legislations connected with the special status of the state as the atmosphere of peace and security has been already threatened by continuing public uprising against civilian killings in Kashmir.
Highly condemnable is the repeated attempts of the BJP and its political and non political affiliates to weaken and abrogate some key legislations connected with the special status of the state. On one hand the Modi government is showing its willingness to talk to estranged political groups with the constitution of India but on the other hand it shakes the very foundation of the special status of the state granted under article 370 of the constitution of India. Chief Minister Mehbooba Mufti has very rightly asked the Modi government to stop tinkering with the article 35 A as otherwise not even a single person in Jammu & Kashmir would like to hold tri colour in Jammu & Kashmir state. Modi government has to understand the ramifications of the disintegrating tendencies of the political and non political affiliates of BJP and stop encouraging its affiliates from laying legal traps against article 370 and related legislation in Supreme Court, Delhi High Court and Jammu & Kashmir high court.
