Man involved in hit and run case sentenced for over 2 years imprisonment

Srinagar: The Additional Special Mobile Magistrate Awantipora has convicted a man involved in hit and run case on National Highway in Awantipora.
Court of Additional Special Mobile Magistrate Awantipora with Miss Fozia Paul in chair, after hearing Mr. Khurshid Ahmad Sr. Prosecuting Officer for the state and counsel convicted a person identified as Nazir Ahmad Mir son of Ghulam Mohammad Mir a resident of Nand Marg Tehsil Damhal Hanjipora for causing death of a pedestrian namely Ali Mohammad Lone son of Qadir Lone resident of Chersoo for rash and negligent driving. The convict was driving a Bus bearing registration number JK03-2045 and had hit the said person on 04-06-2008 on NHW at Chersoo without holding a driving license.
He has been sentenced to undergo imprisonment for a period of two years and a fine of Rs 5000 fine for the commission of offence punishable under section 304-A/RPC. The convict has also been sentenced to undergo imprisonment of one month with fine of Rs. 500/= for the commission of offence punishable under section 279/RPC and shall also under go one more month imprisonment for the commission of offence punishable under 3/181 of M.V.Act.
The trial court turned down the plea of convict for release on probation in terms of section 562/ Cr.P.C after Mr. Khursheed Ahmad Sr. Prosecuting officer presented the strong opinion.. While referring various judgments of Supreme Court of India the court observed that “bearing in mind the galloping trend in road accidents and the devastating consequences visiting the victims and their families, criminal courts can not treat the nature of offence U/S 304-A/RPC as attracting the benevolent provisions of the Probation of offenders Act”. Later the convict has been lodged in District Jail Anantnag( Mattan) in pursuance of orders of trial court to serve the sentence.
