*SMC Seals Humhama Guest House for Major Building Violations*

Srinagar, Dec 12, : The Srinagar Municipal Corporation (SMC) has sealed a multi-storey guest house at Humhama after finding major deviations from the approved building plan, including the construction of an unauthorized additional floor and over 768 square feet of cumulative violations.

The action has been taken against Parvaiz Ahmad Wani and others, who were granted permission in July 2022 to build a basement-plus-four-storey guest house. However, officials reported that the permit holders raised an illegal extra fourth floor, breaching sanctioned limits and continuing construction despite a High Court direction maintaining status quo.

According to the sealing order, a copy of which lies with news agency Kashmir Dot Com, SMC had earlier issued show-cause and demolition notices under Section 253(1) of the J&K Municipal Corporation Act, 2000. The demolition notice was first challenged before the J&K Special Tribunal, which refused interim relief on December 2, 2024, observing that adding an extra floor amounts to a major violation.

The matter was later taken to the High Court of J&K and Ladakh, which on December 10, 2024 stayed both the tribunal’s order and the demolition notice, pending objections. Yet, the Corporation states that construction continued in “deliberate defiance of law,” prompting issuance of a sealing show-cause notice in August 2025. The reply submitted by the offenders was found “devoid of merit.”

Subsequent inspection by the Enforcement Officer (South) on November 12, 2025 confirmed extensive deviations and the completely unauthorized fourth floor constructed without permission.

Citing powers under the J&K Municipal Corporation Act, 2000 and the J&K Unified Building Bye-Laws, 2021, the SMC Commissioner ordered the sealing of the structure.

The sealed premises have been placed under the Superdari of the Station House Officer, Police Station Humhama, and the Ward Officer, Ward 33. Both officers have been directed to maintain the sealed status and report any violations immediately.
