“The dark days of emergency have show that how damaging it is when democratic systems are weakened, showing the severe results of neglecting the rule of law.”

On June 25th annually, India solemnly commemorates 50th  anniversary of the Emergency, a defining and deeply impactful period in its modern history. This day is dedicated to reflecting upon the extraordinary circumstances that led to the imposition of internal emergency powers by the then Prime Minister Indira Gandhi in 1975. The imposition of the Emergency serves as a potent and enduring testament to the inherent vulnerability of democratic systems, starkly illustrating the devastating consequences that can unfold when democratic institutions are undermined and the fundamental principles of the rule of law are disregarded or maliciously perverted. Moreover, this anniversary serves as a powerful tribute to the extraordinary bravery and resilience demonstrated by the Opposition during this intensely challenging era. This diverse and formidable coalition, far from being limited to established political figures, encompassed valiant activists, insightful writers, dedicated students, courageous journalists, and a vast multitude of ordinary citizens. Together, they united with unwavering resolve to challenge the prevailing authoritarian drift and to fiercely advocate for the preservation of their fundamental democratic rights and freedoms. The Emergency period witnessed a systematic and alarming erosion of the crucial checks and balances designed to hold those in positions of power accountable. It instigated a comprehensive and brutal crackdown on the fundamental right to dissent, a right that is absolutely indispensable for the robust health and effective functioning of any democratic society. During this oppressive period, legal frameworks were not merely amended but were often flagrantly misused as tools to facilitate arbitrary detention of critics, effectively bypassing the essential principles of due process and fair trial. Simultaneously, the independence of the judiciary was subjected to immense political pressure, often bending to the weight of partisan machinations.

“A resolution was adopted by the Union Cabinet during a meeting led by Prime Minister Narendra Modi this Wednesday, condemning the emergency declaration made by former Prime Minister Indira Gandhi 50 years prior. The citizens of India have faith in the Constitution, democratic values, and the strength of the nation under Prime Minister Modi’s leadership. This cabinet resolution, guided by Prime Minister Modi, signifies a commitment to acknowledge and honor the sacrifices of numerous individuals who courageously opposed the emergency and the degradation of the fundamental principles of the Indian Constitution.”

The long-term ramifications of this dark period of emergency interlude in India’s historical narrative continue to cast a long shadow. They fuel persistent and deeply ingrained anxieties about the potential for a regression towards authoritarianism and raise ongoing concerns regarding the steady erosion of vital institutional integrity and safeguards. While certain commendable acts of remorse and efforts to acknowledge and rectify past transgressions have begun to emerge, these initiatives are, by all accounts, still nascent and fall significantly short of providing a complete and equitable redressal. A truly comprehensive and meaningful engagement with this painful epoch in the nation’s collective memory demands more than superficial gestures. It requires a profound and unvarnished admission of the deep and enduring scars inflicted upon the very fabric of the nation. Crucially, it necessitates a renewed and unwavering commitment to the vigilant safeguarding of those democratic values and principles that are absolutely fundamental to parliamentary democracy in this country-India. As a resolution passed by Union Cabinet at its meeting chaired by Prime Minister Narendra Modi on Wednesday this week condemned the declaration of emergency by the then Prime Minister Indira Gandhi 50 years ago, the people of India repose their trust in the Constitution, democratic ethos, and the nation’s resilience under the leadership of Prime Minister Modi. The resolution of the cabinet under Prime Minister Modi is a resolve to commemorate and honour the sacrifices of countless individuals who valiantly resisted the emergency and subversion of the spirit of the Indian Constitution.
