High Court stays order against Director ULB , MC Pattan

Srinagar: Jammu Kashmir High Court has stayed the order passed by Special Mobile Magistrate electricity (Sub Judge Pattan) against the Municipal Committee Pattan and Director Urban Local bodies Kashmir and has sought detailed comprehensive report from Additional Advocate General Home.
Electricity Magistrate in his order passed on November 14 had directed Director Urban Local Bodies to deposit Rs 2,78,748 in the court and had ordered  that till realization of the amount all the accounts/transactions pertaining to the Municipal Committee Pattan shall be seized, not only that but Magistrate had proceeded further to direct SHO Police station Pattan to  Produce Administrator of Municipal Committee Pattan and submit the compliance report for registration of case against them.
Sub Judge Pattan as Special Mobile Magistrate electricity had also directed Police to register FIR against the Executive officer Municipal Committee Pattan.
Accordingly in the case of Diretor Urban local bodies Kashmir vs State, single bench of Justice Ali Muhamamd Magray stayed the order as well as the proceedings of the case before the trial court till further orders.
Court also Directed Additional Advocate General to file detailed and comprehensive status report regarding the registration of the case  at Police Station Pattan via order dated 14 November 2017.
Director Urban Local Bodies was represented by Advocate Mehrajuddin Bhat and Respondents were represented by Advocate BA Dar and Advocate R A Khan.
Case has been listed for further proceedings on 18 December this month.
