“50% transport fee for the winter vacation period by all standards of understandabilities is an undue burden on parents who are already reeling under the financial strains of private education in Kashmir.”
The arbitrary order of the J&K Government’s Committee for Fixation & Regulation of Fee (J&K FFRC) allowing private schools to charge students 50% bus fee for the winter vacation period of 2-3 months shows that the fee fixation and regulation committee instead of regulating the fee structure at private schools has delivered an open license to them to carry forward their cash fleecing practices as usual. While the fact remains that private schools randomly disengage drivers for the winter vacation period, the arbitrary order on charging student 50% bus fee for the winter vacation period shows that the instead of taking care of the students and the parents the J&K FFRC by virtue of its actions has sided with the private schools of Kashmir Valley just to give them a free hand to commercialise school education in Jammu & Kashmir. In fact the actions of the incumbent Chairman J&KFFRC Justice (Retd) Sunil Hali both on the admission and as well as bus fee during last one year are in conflict with the guidelines set for regulation of fee structure of private schools by J&K FFRC by virtue of an act passed by the assembly of erstwhile Jammu & Kashmir state long back. Above all 50% transport fee for the winter vacation period by all standards of understandabilities is an undue burden on parents who are already reeling under the financial strains of private education in Jammu & Kashmir.
“While it is the professional duty of Justice (Retd) Sunil Hali both as Chairman J&K FFRC and as well as a retired high court judge not to allow the occurrence of such a situation which would force students and parents to go against his decision in the J&K High, the withdrawal of the arbitrary order on 50% bus fee payment for the winter vacation period deserves immediate attention and intervention of the incumbent J&K FFRC Chairman Justic (Retd) Sunil Hali. Above all the matter also demands and deserves immediate attention of the Principal Secretary School Education Department who exercises administrative control over the J&K FFRC.”
Asking students to pay for the services which they don’t avail for the winter vacation period is a sheer injustice done to them by none else than a retired judge of the High Court without given them even the opportunity of placing on record their genuine and legitimate grievances. Since Justice (Retd ) Sunil Hali as a high court judge has been part of judiciary which is the last hope of justice to people in every state and union territory of the country, the order on 50% bus fee payment for the winter vacation period is questionable and challengeable in the eyes of law before the J&K High Court.
