Trap case: Court of Special Judge, ACB convicts Patwari Kreeri Shangus

Srinagar: Court of Special Judge, Anti Corruption, Anantnag Wednesday convicted then Patwari Kreeri Shangus, Anantnag in a trap case for demanding and accepting bribe.
According to a statement issued on Wednesday the Court of Special Judge, Anti Corruption, Anantnag convicted an official namely Abdul Aziz Wagay, then Patwari Kreeri Shangus, District Anantnag in a trap case under FIR number 02/2009 P/S VOK now (ACB) under section 5(2) P.C Act. and Section 161 RPC.
The accused was sentenced simple imprisonment for a period of 18 months under section 5(2) of J&K Prevention of Corruption Act and one year under section 161 RPC and a fine of Rs 10,000 and Rs 5000 under each offence for demanding and accepting Rs 500 from complainant for issuance of revenue extract, the statement said.
“The brief facts of the case are that on 31-1-2009, complainant approached Sr. Superintendent of Police Vigilance Organization Kashmir (Now ACB South Kashmir) with a written complaint alleging therein that he approached Patwari Halqa Kreeri Shangus Abdul Aziz Wagay for obtaining Revenue Extract (Fard Intikahab) of the land mutated in his favour and his brother after the death of his father. The concerned Patwari demanded Rs 1000 as bribe for issuing revenue extract (Fard Intikhab) which was settled to be paid on 31-1-2009. The complainant produced Rs 500 for giving the same to the accused Patwari. The complainant requested for legal action against the said Patwari Halqa Kreeri Shangus.”
“On receipt of the complaint, the instant case was registered at P/S VOK (now ACB) and investigation taken-up. During the course of investigation a trap team was constituted including an independent witness. The trap team caught Patwari Abdul Aziz Wagay red handed for demanding and accepting a bribe of Rs 500 from the complainant. After completion of investigation the charge sheet of the case was filed before the competent court.”
The trial of the trap case was under adjudication before the Court of Special Judge Anti-Corruption Anantnag. The trial court after examining the prosecution witnesses and after hearing the Special Public Prosecutor and Defence Counsel convicted the accused, the statement said.
The statement said that the accused Abdul Aziz Wagay, has been found guilty and sentenced to simple imprisonment for a period of 18 months under section 5(2) of J&K Prevention of Corruption Act and one year under section 161 RPC and a fine of Rs 10,000 and Rs 5000 under each offence
