The announcement of 12% bus fee hike for transport services in private schools by Fee Fixation & Regulation Committee (FFRC) a statutory body of Jammu & Kashmir Government established for regulation of fee structure in private schools has though brought respite to both the parents and as well as the students, but Jammu & Kashmir Private Schools Association (PSAJK) announcing to challenge the FFRC order in the Jammu & Kashmir high court shows it’s brute arrogance and tendency to challenge the writ of the Government and the authority of a statutory body of the government called FFRC. In one way or the other the J&K Private Schools Association (PSAJK) tends to challenge the writ of the Government on revision of fee structure including the bus fee in Private Schools. While even the trade unions representing employees of several Government departments are not allowed to impose their own decisions but are instead asked to negotiate demands for final settlement of contentious institutional and administrative issues, the J&K Private Schools Association (PSAJK) a representative body of some private schools not accepted by many other private schools including missionary schools is virtually overtaking the power and authority of the Transport Commissioner empowered by the Government to revise passenger fee by announcing it’s own bus fee rate card for private schools . Announcing to challenge the bus fee rates fixed by Fee Fixation & Regulation Committee (FFRC) in the Jammu & Kashmir high court is by all standards of understandabilities an attempt of the J&K Private Schools Association (PSAJK) to challenge the wisdom of a very senior former judicial officer of Jammu & Kashmir High Court as Fee Fixation & Regulation Committee (FFRC) is headed by a retired judge of the J&K High Court whose integrity is above board.
The officers bearers of J&K Private Schools Association (PSAJK) though owes explanations for challenging the writ of the government, the wisdom of a former senior Judge of J&K High Court heading a statutory body of J&K Government and also the interests of the school owners, students and the parents, but this association like many trading bodies and trade unions of both Kashmir Valley and Jammu division is no where accountable before the government. The brute arrogance of J&K Private Schools Association (PSAJK) has to end one or the other day and better for the top helmsmen of the Government to take a serious note of the brute arrogance and uncontrolled unilateralism of J&K Private School Association (PSAJK).
By all standards of understandabilities tendency of J&K Private Schools Association (PSAJK) to challenge the wisdom of the veteran judicial officers always held in high esteem by people of all shades and opinions across the country shows the brute arrogance of the office bearers of PSAJK. So for attempts of PSAJK to undermine the authority of FFRC have drawn a flak as previously J&K Private Schools Association had engaged veteran Congress leader and a leading legal luminary of the country Kapil Sabil as it’s counsel for challenging an order of Fee Fixation & Regulation Committee (FFRC) on tuition fee but he could appear only in one hearing reportedly at a single hearing counseling fee of Rs 25 lakhs and fortunately FFRC order on tuition fee hike is still in force. This time J&K Private Schools Association may engage any senior lawyer of J&K High Court for challenging the FFRC order on bus fee hike but at the end of the day FFRC’s order on bus fee hike may also remain unchanged the way it’s order on tuition fee remained unchanged even after challenging it in the Supreme Court of the country. Collection of contributions from private schools for the counseling charges of lawyers engaged for contesting cases against FFRC is also tantamount to exploitation of even private school owners whose money goes down the drain in the courts . Consequently parents and students whose school fee supposed to be used for tuition and allied school activities is used against them in the court and henceforth they too get exploited.
