Srinagar: A dissident BJP MLA Gagan Bhagat has moved Supreme Court to challenge the dissolution of Jammu and Kashmir assembly by Governor Satya Pal Malik.
A peition titled Gagan Bhagat Ex-MLA Jammu and Kashmir assembly v/s Union of India through secretary, ministry of home affairs, Government of India and state of Jammu and Kashmir through Governor and chief secretary has been filed by Gagan Bhagat in the Supreme Court of India which was formally admitted. The case is likely to come up for hearing next week.
Quoting sources local news gathering agency KNS reported that Gagan Bhagat, a dissident MLA of BJP from Jammu, has moved Supreme Court with a petition challenging the dissolution of Jammu and Kashmir Assembly prematurely.
When contacted Gagan Bhagat said “Yes I have challenged the dissolution of Jammu and Kashmir Assembly in the Supreme Court of India and the petition was on Thursday formally admitted by the top court of the country.” Meanwhile another BJP dissident MLA Deena Nath Bhagat has come out in open support of Gagan Bhagat on challenging the dissolution of J&K assembly in Supreme Court of India.
Deena Nath was representing Chennani constituency in Jammu region.
When contacted Deena Nath Bhagat said that floor test should be conducted before inviting anyone for government formation in Jammu and Kashmir.
Sources also claimed that Gagan Bhagat is presently drawing close proximity with the top brass of National Conference.
The challenge to dissolution of assembly comes amid reports that election commission is mulling to club J&K assembly elections with the forthcoming Lok Sabha elections in the country.
